Terms & Conditions

A.  APPLICATION

  1. Please show a valid passport or ID card.

  2. Please ensure that the passport is valid for more than 6 months before date of departure and sufficient blank pages for entry purpose; having a valid entry visa (if necessary).

  3. Deposit fee is 50% of total bill amount. Balance must be paid 14 days before departure (payable 21 days before the peak season). If the payment is overdue, our company may invalidate the reservation. The payment of the deposit will not be refunded to customer or transferred to third parties usage, overdue payment customer cannot request for other days of departure or joining other tours.

  4. Payment by credit card is accepted; please keep the receipt for refund purpose (if applicable). Payment by credit card’s customer should bear the relevant bank charges fee if refund occurred, refund timing and all relevant terms are subject to bank’s policy.

  5. Airline definition of age: 0 to 23 months considered as babies, 2 to 11 years considered as children, and 12 or above considered as adults.

  6. For customers under age of 18, the following registration requirements must be met; for children under 15 years of age, they must be traveled together with their parents or guardians; for those who are 15 years old and under 18 years of age, if they are not travel with their parents or guardians, they must have parents or guardians signed on agreement form and have a suitable travel insurance.

  7. For other travel products (air tickets, hotels, car rentals, tickets, ferry tickets, etc.) that are reserved by our company, the full amount of the product must be paid within our specified date.

  8. The price of all (FIT travel package) is based on one adult (share half room) and at least 2 persons joined (only applicable to Macau/Hong Kong residents). Date of hotel & flight ticket for the FIT customer are booking in same date and same flight, same group FIT customers requesting for different check in and check out time for each individual is not applicable.

  9. Price of all (FIT travel package) does not include personal consumption and visa fees.

  10. Price of all (FIT travel package) does not cover travel insurance. Customers are strongly recommended to purchase valid travel insurance on their own.

  11. In view of the fluctuation in foreign currency and cost of fuel; transportation tickets; hotels, insurance etc,. Our company reserves the right to adjust the tour fees (if applicable) before departure day of the trip. The surcharge price of fuel is subject to the final announcement of the airline. All fees must be settled by customer in full before departure.

  12. Our company reserves the right to accept or reject customer’s registration for our tour product or not.

   

B.  OUTBOUND TOUR INCULDED

  1. Insurance: Tour members enjoy free life insurance within period of the trip (the maximum life insurance limit is MOP100,000), all insurance terms and conditions such as insured age restrictions, non-insurance matters are subject to the insurance contract or policy of the Insurance Company or Agent. This life insurance does not cover travel insurance and will not compensate any personal injured or personal property damage/loss during the trip. Tour members should purchase a valid travel insurance on their own.

  2. Airfare: Round-trip economy class ticket (for outbound tour).

  3. Hotel: According to the hotel or similar level listed in the itinerary, two persons sharing a standard twin room.

  4. Meal: Daily breakfast, lunch and dinner are subject to the schedule of itinerary.

  5. Transportation: Air-conditioned sightseeing purpose vehicles.

  6. Tour Guide: Professional tour leader and guide will companion with the tour and provide professional services along the route. If the number of the tour group is less than 15 people, under such circumstances our company has the right not to send tour leader to accompany with the tour.

  7. Baggage: Each passenger is limited to one piece of baggage (weighing no more than 20 kg (44 lbs)) and 1 piece of hand luggage. The specifications of baggage are not more than 22 X 14 X 9(inches), size of baggage please referred to airline’s policy.

  8. Sightseeing: All tour programs and admission fees (if applicable) are subject to the itinerary mentioned.

  9. Infant (0 to 23 months) charges only include airline handling fees, excluding extra arrangements for seats, hotels, meals and transportation.

  10. If you are satisfied with the services provided by our team during the trip,  award or tip offered depending on your wishes is welcome.

 

C.  OUTBOUND TOUR NOT INCULDED

  1. Comprehensive travel insurance.

  2. Fees for entry visas to over sea countries (if necessary) and relevant handling fee.

  3. Service fee for the team leader, local tour guide and driver as stated in itinerary (applicable to outbound tour).

  4. National airport taxes, designated taxes and overweight baggage fees.

  5. Baggage service fee for hotels, airports and others transportation.

  6. Tourist programs or event not listed in the itinerary.

  7. Additional costs incurred due to traffic delays; strikes; typhoons or other unexpected circumstances that our company cannot projected or control.

  8. Customer self-funded items and personal consumption.

      

D1.  CHANGE OR CANCELLATION  (OUTBOUND TOUR)

  1. Our company has the right to cancel the tour before the departure of the tour (if the number of participants is less than 15 people or short of air ticket or participant’s visa being rejected, etc.). Under such circumstances, the company will refund the tour fees paid by the customer in full (excluded consular visa fee) and our company will not be liable or compensated for the cancellation of the tour or any other joint liability. 

  2. In accordance with Article 43 of the Macau Government Decree (Transfer of Contract Status), the transferor and the transferee must notify travel agency as soon as possible before day of departure, transferor or transferee are jointly and severally liable and burden to the additional costs incurred due to contract status amended, changes in status are subject to the terms and conditions of each service provider. Besides, consignment in travel product on behalf of other cooperative travel agencies, changes in participating parties is subject to the terms and conditions of the cooperative travel agencies whom have the right of interpretation for the travel products.

  3. According to Article 47 of the Macau Government Decree (the right of customer to terminate the contract), if the customer cancels the contract, he/she shall liable and burdens to the loss due to reservation that has been made and cannot be cancelled by travel agency. Therefore, if the customer needs to amend date of departure or return; name on air ticket or hotel booking or cancellation of the reservation, all the expenses and losses of our company will be borne by the customer and the relevant fees should be settled.

  4. Any tour of Asia Airlines, Tiger Airways or other low-cost airlines cannot be changed or cancelled once customer registered.

  5. If customer decided to transfer or cancel the reservation, he/she must be in writing or in person to notice our company. By telephone or email notification will not be accepted.

  6. If customer/participant suddenly withdraws during the trip or does not participate in any group activities (such as meals, sightseeing or accommodation) will be considered as voluntary abandoned.

  7. Our company may cancel the outbound tour due to force majeure reasons, customer can choose to reserve the tour fee for half year or by paying our refund handling fee (see below*) and will receive the tour fee after relevant cost from service provider being deducted. Regarding the relevant cost, handling charge or even not refunded are subject to the final reply of the transportation service provider. “Force majeure reasons” refers to travel warnings, wars, political turmoil, natural disasters, epidemics, bad weather, technical problems with transportation, change of traffic schedule by service provider; strikes, industrial actions, World Health Organization and Macao SAR government issued travel warnings at tourist destination etc. *Our company refund handling fee as following: HK50.00 for Guangdong province tour group; HKD150.00 outside Guangdong Province or Southeast Asia (excluding Japan); HKD300.00 in other places.

 

D2. CHANGE OR CANCELLATION  (FIT)

  1. According to Article 47 of the Macau Government Decree (the right of customer to terminate the contract), if the customer cancels the contract, he/she shall liable and burdens to the loss due to reservation that has been made and cannot be cancelled by travel agency. Therefore, if the customer needs to amend date of departure or return; name on air ticket or hotel booking or cancellation of the reservation, all the expenses and losses of the company will be borne by the customer and the relevant fees should be settled.

  2. Once the reservation transaction is confirmed, it cannot be changed, cancelled or transferred. If the confirmed reservation (hotel/air ticket/other ticketing, etc.) is changed or cancelled, relevant changes or cancellation will incur additional fees or supplements in retail price or even not accepted subject to the final reply of the service provider.  

  3. If reservation hotel has additional offers, if customer fails to enjoy during the stay, our company will not liable for such losses.

  4. All kind of product items of our company that are not utilized by customer in a valid time, products may not be transferred; exchanged for cash; refund or request for compensation.

  5. If customer aborts the trip or fail to arrive at the reserved hotel on scheduled timing will be considered as voluntary abandoned. Hotel room reservation will be automatically cancelled and the paid fare will not be refunded.

  6. All travel product changes and cancellation procedures must be directly processed by our company. Any changes or cancellations made by the customer personally and directly with our service provider will be considered as invalid and not acceptable.

  7. All transportation or show tickets must be utilized within the specified date. There is no refund service for invalidation ticket.

  8. The price of the (FIT) travel package is calculated based on the date of the hotel stay. If you need to postpone your stay, you must pay the extra hotel room rate. After the tour package is issued, any unused services (such as airfare, hotel accommodation or any meal) will not be refunded.

 

D3. CHANGE OR CANCELLATION  (VEHICLE ON HIRE)

  1. For tourist vehicles service, cancellation of the vehicle should be noticed by 24 hours prior to the appointment time. If there is no prior notice, 100% fee will be charged according to the reserved car fare.

  2. One-way transfer is a point-to-point service. Should the waiting time of vehicle is over 20 minutes and we have been notified officially to keep waiting for customer, double charge for the one way transfer or by hourly charge will be charged. Should we cannot contact or receive notification from customer, the vehicle service is considered as “NO SHOW” and vehicle will stop waiting, relevant vehicle fare should be paid by customer and is non- refundable.

  3. Midway drop off/pick up customer during an one way transfer is considered as extra stop-point, maximum two extra points allowed per transfer, MOP100.00 surcharge applied for every extra stop-point. The entire transfer (including waiting time) has to be completed within one hour. Should the customer requests an “ad hoc” change on departure time or location, such request is subject to availability. The driver will acquire surcharge for Macau Explorer if such changes involve with non-office hours and locations mentioned on Item D3-5.

  4. If customer requests for tourist vehicle arrival in an early time for setup or checkup purpose, surcharge of MOP100.00 will be charged. 

  5. Surcharge MOP 100 will be applied if vehicle reaching HKZM Bridge-Macau Port Island/Coloane Island/University of Macau (Henqin Island). Further quotation is required if reaching "A-Ma Cultural Village Coloane".

  6. Should the customer cannot provide confirmed route or location before the departure, but the vehicle on-hire service has reached the locations mentioned on Item D3-5, the driver will acquire such surcharge for Macau Explorer.

  7. The Vehicle Rental List & Travel Services listed on this document is for touring and one-way transfer purpose. Should the vehicle is used as a “shuttle” basis (eg, a coach running back and forth between two or more specific destinations), such service is considered as “Exhibition shuttle” and further quotation is required.

  8. For services operate in non-office hours, 07:31-08:59 and 22:00-22:59, surcharge MOP150/transaction applied for vehicle and tour guide respectively (e.g MOP150 for each driver & guide). For midnight-early morning hours 23:00 -07:30, further quotation is required.

  9. Children must be accompanied by an adult.

  10. Car rental fee is non-refundable once it is paid.

  11. Under No. 8 typhoon signal, for those service orders of rental vehicle that has not been executed will be stopped and cancelled, the rental fare will be refunded (credit card transaction surcharge may apply) to customer. Under typhoon signal No. 1 or No. 3, car rental services will provide as usual and relevant service order cannot be cancelled. Driver reserves the right to alter the itinerary due to weather and other unforeseeable conditions.

  12. Our company is not responsible for the loss caused by the weather or traffic conditions that affects passenger who fail to get on board on time to all kind of transportation services or fail to enter performance venues on time.

  13. Any vehicle services provided by Macau Explorer includes third-party liability insurance ONLY, it EXCLUDES customer’s individual travel insurance.

  14. All vehicles provided by our company are for tourism purposes and are prohibited to provide cargo/beverage/pet etc. delivery services.

  15. When number of passengers exceeds the quorum capacity of vehicle, our driver has the right not to drive until number of people on board has been coordinated.

  16. For vehicle pick up or drop off passengers to terminal/harbor/airport/major site visiting point of Macau, according to the regulations of the Tourism Bureau, more than 9 passengers in vehicle are consider as group travel and must be guided or coordinated by a local guided with valid license.

  17. Our staff will inform to passenger that size of baggage our vehicle can be storage, Passenger should consider size of their baggage carried will exceed the storage space of vehicle or not.

  18. The terms and conditions or services provided by our company is considered acceptance once payment is confirmed.


D4. CHANGE OR CANCELLATION  (LOCAL TOUR)

  1. Tour Fare is non-refundable and cannot be amend or cancel once it is paid.

  2. The tour will be operated in seat-in-coach basis and a minimum number of guest is required.

  3. For total number of 6 guests or below, the tour will be operated in driving-guide basis with a cozy MPVs, licensed tour guide as driver.

  4. Waiting time over 15 minutes after actual departure time will count as "NO show", tour fare will not be refunded.

  5. Tour Operator reserves the right to alter the itinerary due to weather and other unforeseeable conditions.

  6. Children must be accompanied by an adult.

  7. A moderate amount of walking is involved.

  8. If unforeseeable circumstances force cancellation of a specific performance/activity, the tour will remain visit similar hotels or sightseeing points, tour fare will not be refunded.

  9. For statutory holidays and festivals in Macau (such as Grand Prix Day), the package fee must be quoted separately.

  10. If typhoon signal has reached Level 8 at 22:00 p.m the night before the tour, or before the start of tour (e.g. announcement at 7:00 a.m), full tour fare will be refunded (credit card transaction surcharge may apply). Tour will remain proceed under typhoon signal Level 1 or 3.

  11. Any vehicle services provided by Macau Explorer includes third-party liability insurance ONLY, it EXCLUDES customer’s individual travel insurance.

  12. All items are subject to the terms & conditions of Macau Explorer Cultural Travel.


E.  SPECIAL CIRCUMSTANCES AND LIABILITY

  1. Due to special circumstances that cannot be control such as wars, political turmoil, terrorist attacks, natural disasters, epidemics, bad weather, technical problems with transportation, change in traffic schedule by service provider, strikes, industry actions, World Health Organization and Macao SAR government issued travel warnings at tourist destination etc. Our company has the right to take any reasonable action due to unfavorable circumstances occurred, including but not limited to cancel or shorten the travel itinerary, changing in hotel or reducing travel programs. Our company will not be responsible for any additional costs and customer may not object to or withdraw from the tour, or request to refund due to the travel itinerary changed or unfinished.

  2. Service organization such as transportation (such as airline, cruise ship, train or bus), accommodation, meals, sight-seeing or entertainment activities arranged by our company are not owned, managed or operated by our company. All the above arrangements made by our company are on behalf of the customers, any tickets, documents, receipts, contracts or notes issued on behalf of the above-mentioned service organization are issued in accordance with the rules and conditions pre-planned by the above-mentioned service organization. In the event of traffic delays, loss or damage of baggage and accidental casualties, the customer shall directly negotiate or claim with relevant service organization that owns; manages or operates according to their rules and regulations, our company will not responsible for the loss or injury. If the customer encounter accident when participating any entertainment or game project during the trip, resulting in casualties or property damage, our company will not be responsible for any casualties or property losses.

  3. All entertainment activities in the itinerary are designed and arranged according to the overall demanding. However, when customer participating in such activities, customer should follow the guidelines and arrangements of the service staff. Customer should assessing whether his/her age, physique and health assessment are suitable be joined and undertake the consequences of all responsibility arising therefrom. When the customer thinks it is necessary, he/she should seek the advice from a doctor or professional. 

  4. Except for personal injury or death caused by the negligence of our employees or entrusting agency directly managed or operated by our company, we shall not be liable for any personal injury, economic, entertainment or spiritual loss suffered by the customers in accident.

  5. Except with the special consent and arrangement from our company, tour member cannot transfer/ handover/replacement his/her member rights to third party during the trip, staff of our company or entrusted agency has the right to reject and terminate the qualification of those non-member without having to reimburse any tour fees. The insurance, liability compensation, and behavioral consequences during the trip will be borne by the non-qualified individual.

  6. Accommodation, meals, and tours arrangement are according to the itinerary. In the event of special circumstances, such as tour member’s visa being blocked, hotel check in problem or change of flight schedule etc., that cannot be controlled by our company or entrusted agency, we may increase or decrease the tour program or change of accommodation in such circumstances. All members of the group shall not object to or withdraw from the tour, our company and entrusted agency are not liable for such changes and burden additional expenses incurred.

  7. Our company or entrusted agency has the right to terminate the qualification of those members who does not comply with the guidelines or arrangements of our service staff or customer who insults or harasses other members in action or speech during the trip, our company will not refund his/her tour fare. Under the age of 18 who are under the supervision of the non-cooperating member must also be left. The activities of the non-cooperating member after his/her leaving of the group are irrelevant to our company or its entrusted agency.

  8. If tour member leaves the group or gives up joining the tour, all consequences responsibility shall be borne by customer after his/her leaving, our company and entrusted agency will not burden for the property loss or injury of quit member.

  9. Tour group/FIT customers must abide to the laws of various countries. It is strictly forbidden to bring illegal items and customer should clearly declare content of belonging and cash in hand when arrival to various countries.

  10. The approval of the entry visa for each country shall be determined by the consulates of each country at its sole discretion, our company or entrusted organization shall not be liable for visa application result. If visa application has been submitted, the visa fee will not be refunded. If visa application processing by customer on their own, any problems encounter in entry or departure of a visiting country, our company will not burden the loss of customer being generated due to visa validation problem.

  11. Under circumstances of Tour member/FIT customer being refused entrance to various countries by on duty customs officer even though he/her holds a valid visa or travel document, our company or entrusted agency will not be liable to this circumstance. Additional accommodation and transportation expense if occurred are all borne by customers, rest of the itinerary customer cannot join or accompanying will not be received any compensation, no refund or reorganization can be requested. 

 

F.  AIR LINE LIABILITY

  1. According to the airline's guidelines, if the ticket is not used in sequence, it will be invalid. Therefore, if the passenger fails to on board for personal reasons and requests to reserve the validity of ticket (departure or return), the airline has the right to charge additional fee from passenger or requested passenger to purchase a whole new ticket.

  2. Passengers should read the airline's instructions or contact airline customer service for unsure items before departure, for passenger cannot on board in time, the airline will have no responsibility or compensation to passenger.

  3. Customer should provide all participants’ information that are same with his/her passport or travel documents. Customer should clearly check with the passenger information printed on our invoice/receipt. As long as our company has issued the air ticket or the hotel confirmation, if the information provided by customer is not correct and needs to be amended, additional amendment fee or re-purchase a new ticket at normal price may be requested and all charges shall be borne by the customer.

  4. Consigned products or air ticket products are subject to the terms and conditions announced by the relevant agent or airline.

  5. According to the practice of airlines, customers are required to confirm their flights 72 hours prior to departure with airline’s customer service. Any changes to the flight are irrelevant to our company.

  6. Passenger must arrive and check in at the airport 2-3 hours early before his/her air ticket’s departure time. Our company is not responsible for the loss caused by the late arrival or failure to on board.

  

G.  TYPHOON / BAD WEATHER ARRANGEMENT

  1. Outbound Tour: Even though typhoon signal No.8 has announced to public by Macau Government, tour member are request to gather at the meeting place (such as airport, harbor, terminal etc.,) according to the itinerary scheduled time, unless notice from our team leader or staff’s confirmation that the outbound tour has been cancelled or postpone.

  2. Local Tour: Our Macau local day tour will remain proceed under Macau ‘s typhoon signal level 1 or signal level 3. Based on customer safety considerations, our Company has the right to shorten or change the remaining itinerary due to unfavorable circumstances, and the relevant tour fare will not be refunded. If typhoon signal has reached Level 8 at 22:00 p.m (Macau Time) the night before the tour, or before the start of tour (e.g. announcement at 7:00 a.m), full tour fare will be refunded (credit card transaction surcharge may apply). Tour will remain proceed under typhoon signal Level 1 or 3.

  3. Vehicle on Hire: Under No. 8 typhoon signal, for those service orders of rental vehicle that has not been executed will be stopped and cancelled, the rental fare will be refunded (credit card transaction sucharge may apply) to customer. Under typhoon signal No. 1 or No. 3, car rental services will provide as usual and relevant service order cannot be cancelled.

  4. AIR LINE: Under any level of typhoon signal, the cancellation or postpone to the flight is subject to the announcement of airline. All changes to the departure date/time or refunds are subject to the airline's final decision.

  5. Hotel Reservation: Due to the weather/typhoon impact, if customers are unable to stay in a foreign or Macau’s hotel as schedule because of traffic (air/car/ship) problems, refund or check in postpone (if applicable) are subject to policy of each hotel. Customers can provide our receipt or hotel check-in information for our follow up, our company will entitle service charges HKD50.00/room from customer. The amendment is subject to the availability of the hotel room and the customer may need to pay extra fee or even zero refund, relevant fare paid by customer will not be refunded.

  6. Sea/land transportation: Under the impact of bad weather/typhoon, the cancellation or postpone of the flight/shift is subject to the announcement of transportation provider. According to the instruction of transportation provider, customer can provide their ticket for new ticket exchange or postpone on board.

  7. Our company is not responsible for the loss caused by the weather or traffic conditions that affects passenger who fail to get on board on time to all kind of transportation service or fail to enter performance venues on time.

 


Remark: The Chinese version of these terms and conditions shall prevail wherever there is a discrepancy between the English and Chinese version. This English translation is for reference only and not legally in force.
